La posición de garante en virtud de una comunidad de peligro

Abstract

Desde una perspectiva teórica general, esta monografía expone los aspectos fundamentales del delito de omisión, tales como concepto, elementos y clases de omisión; evolución dogmática del concepto de posición de garante, su alcance y límites; regulación legal del delito de comisión por omisión en el derecho penal colombiano, con una breve alusión a los principales referentes en el derecho comparado. En ese contexto, el libro sistematiza los criterios dogmáticos sobre los cuales delimita los contornos conceptuales de la comunidad de peligro como fuente de la posición de garante, partiendo del análisis de sus tópicos estructurales, a saber: naturaleza jurídica y ubicación sistemática de la institución; concepto, fundamento y ámbito de la situación denominada “comunidad de peligro”. Como resultado de ese marco jurídico el autor fija los elementos dogmáticos que integran el concepto de comunidad de peligro generadora de posición de garante y su espacio de aplicación.
