Los actos administrativos contractuales proferidos en virtud de poderes excepcionales y el arbitraje en Colombia

Abstract

El objeto de investigación de la presente monografía es la discusión planteada en torno a la competencia de los árbitros para pronunciarse sobre la legalidad de los actos administrativos contractuales proferidos en virtud de poderes excepcionales. El tratamiento jurisprudencial dado por el Consejo de Estado y por la Corte Constitucional al arbitramento estatal, especialmente por la tesis negativa, ha minado la eficacia práctica del arbitraje en Colombia. Luego de describir el estado de la discusión, la autora toma posición frente a la problemática jurídica planteada, empleando para ello los criterios metodológicos clásicos de interpretación.
