Abstract

El presente trabajo tiene como objetivo presentar la respuesta legal, doctrinal y sobre todo jurisprudencial más actualizada sobre el tema del fraude al contrato de trabajo; es decir, cuando, contrariando el ordenamiento jurídico y en detrimento de los intereses de los trabajadores, se utilizan contratos diferentes a los laborales para evadir las cargas que este implica, y en forma viciosa se acude a cooperativas de trabajo asociado, empresas de servicios temporales, outsourcing y contratos civiles y comerciales, figuras que por supuesto tienen su razón de ser, son legales y legítimas, pero que en determinados eventos son mal utilizadas por exceder con su uso los fines normativos previstos.
