La culpa contractual en el sistema jurídico latinoamericano

Abstract

Este trabajo hace un recorrido en torno de la noción de responsabilidad contractual y nos muestra los momentos más relevantes y sus perspectivas. Es así como se presenta un marco general del derecho romano respecto de dicha responsabilidad, con el propósito de encontrar la continuidad con el derecho moderno, especialmente con el latinoamericano. Asimismo, analiza cómo los códigos europeos perciben e interpretan tal materia y los puntos de discusión que la doctrina considera como importantes. Por último, presenta las normas de los códigos civiles latinoamericanos y de la doctrina que los comenta. Hay un anexo con las principales normas citadas.
