Abstract

Este trabajo ha permitido materializar la escisión del Derecho fiscal en dos grandes vertientes: el Derecho tributario y el Derecho presupuestario; este último es el objeto de este libro, cuyo contenido es fundamentalmente el estudio del gasto público y de la institución jurídica del presupuesto, donde además se presentan de forma lateral las fuentes de su financiación. El Derecho presupuestario es un concepto novedoso en Colombia, acotado a las funciones y autoridades públicas, donde entran en juego aspectos jurídicos relevantes y sustanciales para el desarrollo de las políticas públicas y los principios y reglas constitucionales. Desde esta perspectiva se presenta un estudio acucioso del ordenamiento presupuestario colombiano, que involucra desde la Constitución hasta los reglamentos administrativos, con la pretensión de mostrar una escuela en formación gestada desde el Externado. El principal objetivo que se pretende es la identificación tanto de las bases jurídicas conceptuales del Derecho presupuestario colombiano como el elemento que aglutina el conjunto de normas y relaciones que lo componen.
