Nuevo régimen sancionatorio ambiental

Abstract

Con la expedición de la Ley 1333 de 2009, Colombia cuenta con un nuevo procedimiento sancionatorio ambiental que hasta el momento ha generado en la comunidad académica, en las autoridades ambientales y en los organismos de control, interrogantes y cuestionamientos sobre su conveniencia, oportunidad y utilidad.Esta obra pretende describir y analizar dicho procedimiento, estudiando detalladamente sus antecedentes y orígenes, la presunción de culpa incluida en la ley, las infracciones por violación de la norma o por daño ambiental, las posibles sanciones aplicables por los titulares de la potestad sancionatoria y los aspectos probatorios, entre otros temas que sin duda permitirán al lector estar al tanto del nuevo iter procesal trazado por la Ley 1333 de 2009.
