De los privilegios a la propiedad intelectual. La protección en Colombia a las obras literias, artísticas y científicas en el siglo XIX

Abstract

Durante el siglo XIX Colombia tuvo un sistema legal de privilegios de duración de 15 años para la protección a obras literarias, artísticas y científicas. Las raíces normativas y filosóficas de esta legislación provienen del modelo utilitarista inglés. Al identificar las obras protegidas durante el periodo de 1858 a 1886 se descubre que el sistema de privilegios fue parte de la política de instrucción pública.De esta forma se estimuló la producción conocimiento útil, cuyos destinatarios eran los usuarios del sistema educativo.Con la difusión de las ideas de J.M. Torres Caicedo comenzó el proceso nacional de abolición del modelo de privilegios. Durante 1878-1886 se generó una álgida discusión política y jurídica sobre la adopción de la propiedad intelectual, que coincide con el proceso de un sistema internacional de derecho de autor. La propiedad en Colombia fortaleció el hispanismo e implicó una reforma sustancial en el modelo de nación que la elite construyo.
