Abstract

Este libro presenta algunos resultados de dos proyectos de investigación institucional: "la teoría de los riesgos en el derecho privado colombiano" y "la relación entre el contrato con el consumidor y el paradigma contractual de Código Civil y el Código de Comercio colombiano. Las dos investigaciones fueron adelantadas por el autor para la línea de investigación en derecho contractual del Grupo de investigaciones Jurídicas de la Universidad de Medellín.Existen contratos: éste, aquel, el de mas allá, cada uno con su propia fisonomía "Todo concepto —dice el joven Nietzsche— Se forma por equiparación de contratos no iguales. Todos los contratos, por más diferenciales que los separen, tienen algunos elementos comunes: pluralidad de partes, acuerdo, contenido patrimonial, forma, efectos jurídicos. De eso se trata este libro: de los elementos comunes a todos los contratos.Por las páginas de este libro desfilan autores nacionales y extranjeros, sentencias de casación civil y de constitucionalidad. En algunos puntos, el autor acepta las ideas que dominan la doctrina y la jurisprudencia colombiana. En otros puntos, las críticas, se aparta de ellas y expone ideas alternativas, algunas originales, otras no tanto.
