Abstract

Por solicitud honrosa de la Association Henri Capitant de Amigos de la Cultura Jurídica Francesa y, más ampliamente, de la Latina, y deferencia especial del Prof. Pierre Catala, nuestra Universidad realizó la traducción al español del Ante-Proyecto de Reforma del título III del libro III del Code civil francais y del derecho de la prescripción, elaborado de manera diligente y esmerada por un grupo de civilistas de la más alta calidad y de la mayor prestancia, que trabajó con tenacidad y diligencia sumas, bajo la dirección del Prof. Catala, cual él lo resalta en su Presentación. Dicho Ante-Proyecto fue entregado al Guardasellos, Ministro de Justicia de la República francesa, en el mes de septiembre del año pasado, y tiene vocación de convertirse en puntal de una actualización de la respectiva normatividad, en razón de la calidad y autenticidad del trabajo, el renombre de sus autores, la oportunidad de su realización, las exigencias actuales del derecho de los contratos, especialmente en el concierto europeo, y la presión de las distintas vertientes del derecho privado por una “modernización” del derecho de los contratos.
