Procura existencial, Estado de Derecho y Estado Social. Ernst Forsthoff y la crisis de Weimar

Abstract

El concepto de “procura existencial” está asociado al nombre del iuspublicista alemán Ernest Forsthoff, quien lo acuño para designar el amplio espacio de necesidades que el individuo no está en capacidad de atender efectivamente, requiriendo por ello la asistencia del Estado. En la sociedad industrial, cuya evolución moderna fue motivo de las principales preocupaciones de Forsthoff, la vida se ha hecho más compleja y los bienes y servicios indispensables se han multiplicado. Corresponde al Estado la responsabilidad de garantizar las posibilidades de realización de esas condiciones existenciales, a través de la Administración, que de esta manera recibe una nueva función esencial junto a la tradicional de intervención: la función de presentación. Éste fue sin duda un aporte al Estado de bienestar en la república Federal de Alemania.
