¿Crisis del sistema dogmático del delito?

Abstract

Uno de los temas que han marcado las últimas décadas de la discusión sobre la teoría del delito ha sido el del recurso a la Política criminal como elemento fundamentador del contenido de sus categorías y la incidencia o no de límites externos (en particular, ontológicos) a tal recurso. El modo en que se articulan lo uno y lo otro pone de relieve la trascendencia real de las modernas tendencias hacia la “normativización” de tales categorías. A la vez, en él se manifiestan los principales retos que han de afrontar dichas propuestas. Sobre todo cuando se trata de rebatir las frecuentes críticas que les imputan consecuencias de arbitrariedad, decisionismo e inseguridad jurídica.
