Las insolvencias punibles en la encrucijada del derecho penal y del derecho mercantil. Tras la aprobación de la nueva Ley Concursal española

Abstract

La reciente aprobación en España de la nueva Ley Concursal, en vigor desde el 1.º de septiembre de 2004, incidió en muchos ámbitos del ordenamiento jurídico, tanto del derecho privado como del público. Entre ellos, como no podía ser de otro modo, en el derecho penal. En este trabajo analizamos algunas relaciones entre los ordenamientos mercantil y penal en el ejemplo de los delitos de insolvencias punibles (alzamiento de bienes y concurso punible) tras la aprobación de la nueva Ley Concursal española.
