Abstract

Este texto presenta los lineamientos generales del sistema argentino de medición de la pena, un tema en el cual la elaboración dogmática ha sido muy escasa. La jurisprudencia argentina ha actuado como si los marcos penales fueran un ámbito para el ejercicio de facultades discrecionales sustraído a todo control. De hecho, hasta hoy no se reconoce la posibilidad de recurrir en casación por una errónea determinación de la pena.
