Abstract

Schünemann esboza una panorámica de la actual ciencia jurídico-penal alemana y analiza las concepciones que pueden fundamentar el Derecho Penal de la sociedad postmoderna: la concepción del Derecho Penal como referido exclusivamente al individuo, la cual se manifiesta en la teoría del bien jurídico y en la política procesal penal de Winfred Hassemer y sus discípulos de Frankfurt y la concepción del sistema normativista del Derecho Penal de Günther Jakobs, el cual se basa en la teoría funcional de sistemas y se concibe a sí mismo como el polo opuesto al pensamiento lógico material.
