El neoconstitucionalismo a debate

Abstract

En un volumen de próxima publicación en Colombia, Luis Prieto Sanchís y Juan Antonio García Amado sostienen una controversia de extraordinario interés sobre el concepto y los elementos de una de las corrientes iusfilosóficas y iusconstitucionalistas que despierta hoy la máxima atención: el neoconstitucionalismo. El propósito de este texto es reconstruir las principales discrepancias que estructuran el debate entre estos dos emblemáticos juristas y, en donde sea posible, terciar en él. Para tal fin, en la primera parte analizaré las tesis que dan lugar a la divergencia de pensamiento entre Prieto Sanchís y García Amado. En la segunda, esbozaré mis opiniones acerca de las respuestas adecuadas a algunos de los problemas que están en juego en la discusión entre estos dos autores.
