El derecho de acceso a la justicia en la jurisprudencia interamericana

Abstract

La Corte Interamericana de Derechos Humanos se ha pronunciado sobre el contenido y alcance de los artículos 8.º y 25 de la Convención Americana sobre los Derechos Humanos desde el inicio de su actividad hace ya más de 25 años. Desde entonces, ha sentado las bases para la construcción de una teoría integral sobre el derecho de acceso a la justicia en el sistema interamericano de protección de los derechos humanos, que parte del supuesto de que tal prerrogativa es uno de los pilares que sostiene el modelo de Estado democrático de derecho, así como piedra angular del propio ordenamiento regional sin el cual su tarea de salvaguarda se tornaría inútil.
