Abstract

La creación y expansión de la justicia constitucional se convirtió en el principal progreso del derecho constitucional en el transcurso del siglo XX. Si bien son ya doscientos años los que nos separan de la celebre decisión del juez John Marshall en el caso Marbury vs. Madison de 1803 en Estados Unidos, a partir de la segunda mitad del siglo XX la justicia constitucional se consolida en la estructura estatal europea con el afianzamiento del principio de la supremacía constitucional. El tardío pero sólido consenso transatlántico sobre el valor de la Constitución gestó una nueva concepción del Estado de derecho, ahora Estado constitucional de derecho, y de su relación con los ciudadanos.
