Folgekostenberechnung bei landesrechtlichen Regelungen

Abstract

Die Bundesregierung setzt seit 2006 ein Maßnahmenprogramm zur Vermeidung und zum Abbau unnötiger Bürokratie um. Um die Folgekosten einer Regelung zu berechnen und transparent zu machen, wurden zunächst das international anerkannte Standardkosten-Modell angewandt und die sogenannten Bürokratiekosten berechnet. Mit der Erweiterung des Berechnungsumfangs wurde 2011 der Begriff „Erfüllungsaufwand“ eingeführt und auch sogenannte weitere Regelungskosten, wie etwa die Kosten eines Rauchmelders, der verpflichtend anzubringen ist, erfasst. Der Normenkontrollrat Baden-Württemberg hat im Auftrag der Landesregierung eine länderspezifische Anpassung des Standardkosten-Modells vorgenommen, die seit dem 1. Januar 2021 in Baden-Württemberg angewandt wird. Die Inhalte dieser weiter entwickelten Methode zur Folgekostenberechnung bei landesrechtlichen Regelungen sind Thema dieses Beitrags.
