Abstract

Das Gesetz zur Neuregelung des Energiewirtschaftsrechts vom 20. März 1998 sollte die deutsche Stromwirtschaft auf eine wettbewerbsorientierte Grundlage stellen. Bei den politischen Verhandlungen über diese Neuregelung war besonders die künftige Wettbewerbs- und umweltpolitische Rolle der kommunalen Elektrizitätsversorgungsunternehmen umstritten. Nach dem Regierungswechsel steht nun eine erneute Energierechtsreform bevor. Wie sind die gegenwärtig diskutierten Änderungen des Gesetzes zu beurteilen? Welche Rolle sollten die kommunalen Elektrizitätsversorgungsunternehmen künftig in der Stromwirtschaft spielen?
