Judicial And Out-Of-Court Mediation - Stages In The Procedure

Abstract

The formation and work of judicial mediation centers is regulated by law for the first time in our country with the changes made to the MediationAct (MAct). The legal changes create Chapter Six "Mediation in Pending Court Cases" (New Chapter - SG No. 11 OF 2023, effective July 1, 2024). The new legisla tion concerns the conduct of mediation procedures in a judicial center, including the requirements for the entry of mediators in the lists of mediators at the judicial centers, which will be held at the District Courts. The legal changes raise questions about the specifics of the mediation procedure, the consequences for pend ing court cases of referral to mediation procedures in judicial centers, as well as the possibilities for conducting mediation in out-of-court centers. Knowing about mediation as a process passing through certain successive stages is a necessary part of its understanding and application.
