Trader Stabilization Proceedings - Prerequisites And Practical Aspects In Its Application

Abstract

The subject of this paper is a study of the proceedings for stabilization of the trader, which is introduced by Part Five of the Commerce Act in 2017. It ivestigates the proceedings from the perspective of some practical problems, which may arise during its application. Conclusions are drawn about the difficulties that traders may encounter in connection with the opening procedure and its effective execution. Suggestions for clarification amendments are made to align the Bulgarian legislation with the tendencies and anti-crisis measures of the European Commission (EC) regarding constitution of the financially distressed businesses.
