La reafirmación de las aportaciones de (propiedad de) los socios de las sociedades cooperativas. Propuesta de regulación de las sociedades de responsabilidad limitada cooperativa

Abstract

En el presente trabajo se aborda el estudio de la responsabilidad de los administradores de las cooperativas en situaciones de pérdidas patrimoniales y de insolvencia. El estudio trata de presentar cual es el régimen legal de la responsabilidad en la actualidad, para lo que resulta necesario tener en cuenta el diferente tratamiento de la cuestión en función de las distintas leyes cooperativas autonómicas. El estudio toma en consideración el tratamiento jurisprudencial, que nos permite valorar la trascendencia práctica del tema y conocer la interpretación de los tribunales a las recientes reformas en materia de responsabilidad de los administradores. El régimen de responsabilidad previsto en la nueva Ley Concursal es objeto de tratamiento diferenciado en el último apartado.
