Abstract

Zusammenfassung Die persönlichen Daten der Verbraucher stellen einen Wert dar, der sich auch pekuniär bestimmen lässt. Verschiedene Rabattprogramme wie beispielsweise Payback bieten den Verbrauchern auch einen Gegenwert. Ob dessen Höhe angemessen ist, wird bisher nicht hinterfragt. Zudem gibt es Probleme bei der Interoperabilität digitaler Dienste und der Datenportabilität. Der Autor plädiert dafür, zum einen technische Mindeststandards festzulegen und zum anderen eine Verwertungsgesellschaft Daten einzuführen, die dafür sorgt, dass den Verbrauchern ihre Daten entgeltlich vergütet werden.
