Abstract

Zusammenfassung Im Zuge der Einführung der Niveauschutzklausel in der gesetzlichen Rentenversicherung hat man den Nachholfaktor außer Kraft gesetzt. Um diese unbefriedigende Situation zu beenden, hat das Bundesministerium für Arbeit und Soziales nun einen Referentenentwurf vorgelegt, der darlegt, wie man sich vorstellt, den Nachholfaktor zur Rentenanpassung 2022 wiedereinzuführen. Die Wiedereinführung ist ein guter Schritt. In Anbetracht des Zusammenspiels mit der Niveauschutzklausel ist der Entwurf jedoch noch nicht ausgereift. Darüber hinaus hat man eine Lock-in-Klausel eingebaut, die eine große Last darstellt. Sie wirft ein neues Problem auf, dessen Ausmaß ähnlich groß ist wie das des ausgesetzten Nachholfaktors, das man mit dem vorliegenden Referentenentwurf zu lösen gedenkt.
