Оценка Регулирующего Влияния - Как Эффективный Механизм Развития Инновационного Предпринимательства

Abstract

В статье проанализированы новации в государственном управлении на основе зарубежных и отечественных примеров создания системы оценки регулирующего влияния. Установлено, что в органах государственной власти федерального уровня РФ сохраняется несовершенство организации законопроектной деятельности. Соответствующие недостатки отмечаются в нормативных правовых актах Правительства РФ, являются предметом регулярных обсуждений на Комиссии Правительства РФ по законопроектной деятельности. Показано, что система оценки регулирующего влияния (ОРВ, англ. regulatory impact assessment) может помочь преодолеть эти недостатки, и существенно дополнить существующие механизмы и процедуры юридической экспертизы. Выявлено, что в ряде зарубежных стран внедрение системы оценки регулирующего влияния позволило существенно повысить контроль качества разрабатываемых нормативных актов, систематизировать и осуществить экспертизу качества подготовки нормативных актов с точки зрения достижения целей их принятия и применения.
