Abstract

В статье рассматриваются фундаментальные вопросы функционирования суда присяжных в России во второй половине ХIХ века и в современный период после их возрождения в Российской Федерации в 1993 году. Суд присяжных занимает особое место среди институтов российского правосудия. По своей исторической судьбе это был футуристический эксперимент (он учреждался в стране в 1864 году в ходе беспрецедентной судебно-правовой реформы, когда немногим ранее несколько лет назад, в Российской империи еще действовало неотмененное крепостное право) и смог просуществовать более полувека до 1917 года (начало советского периода), а в последующем был вновь востребован в современной правовой системе России. Изначально суд присяжных в России обладал оригинальными чертами, которые изменялись с течением времени. В современный период в силу объективных и субъективных причин суд присяжных трансформировался в дифференцированный порядок уголовного процесса, предназначенный для рассмотрения уголовных дел на основании ходатайства обвиняемого.
