Соотношение Изъятых, Ограниченных И Запрещенных В Обороте Объектов Гражданских Прав

Abstract

Цель: анализ и сравнение правовых категорий «изъятые из оборота объекты», «ограниченные в обороте объекты» и «запрещенные в обороте объекты». Методы: формально-логический, сравнительный и метод межотраслевых юридических исследований. Результаты: на основе проведенного анализа даны определения ограниченных и изъятых из оборота объектов. Предложены два параметра их разграничения. Показано, что в законодательстве понятие «запрещенные в обороте объекты» используется в значении изъятых из оборота благ. Научная новизна: предложены авторские критерии дифференциации ограниченных и изъятых из оборота объектов гражданских прав. Практическая значимость: результаты исследования можно использовать в правотворческой, правореализационной и правоприменительной деятельности, а также для научных изысканий в области гражданского оборота.
