Субъективные Процессуальные Права В Механизме Арбитражного Процессуального Регулирования

Abstract

Цель: выявить сущность и правовую природу субъективных процессуальных прав в качестве объекта обеспечения. Методы: системный анализ. Результаты: Выявлены структурные элементы и сформировано унифицированное понимание субъективного процессуального права. Определена сущность субъективного процессуального права, которая состоит в гарантированности их реализации. Научная новизна: Переосмыслена система категорий: осуществление субъективных процессуальных прав, исполнение обязанности арбитражным судом, содержание субъективного процессуального права; обоснована необходимость изучения механизма обеспечения субъективных процессуальных прав, которая основывается на необходимости установления как его элементарного состава, так и исследовании последовательного действия. Практическая значимость: Сформулированные выводы могут быть использованы для дальнейшего развития учения об обеспечении процессуальных прав участников арбитражного судопроизводства.
