Abstract

В статье рассматриваются проблемы, возникающие в ходе судебного следствия при производстве у мирового судьи по делам частного обвинения. Автором проанализированы проблемы, связанные с подачей встречного заявления в ходе судебного следствия, предложено авторское определение понятия «встречное заявление», анализируются проблемы реализации прав подсудимого на защиту в ходе судебного следствия при производстве по уголовным делам частного обвинения, проблемы прекращения уголовного дела в ходе судебного следствия при производству у мирового судьи и другие проблемы.
