Abstract

Статья посвящена актуальным вопросам процессуального права, которые позволяют наметить определенные пути его совершенствования. Аргументируется позиция, что арбитражно-процессуальные гарантии представляют собой единый механизм обеспечения процессуальных прав, который является производным от социально-юридического механизма обеспечения прав. Автор обосновывает применение термина «механизм обеспечения процессуальных прав» тем, что в таком аспекте арбитражно-процессуальные гарантии рассматриваются как в динамике, так и в статике. Это, в свою очередь, позволяет изучить специфику процессуально-правовых средств обеспечения, а также изучить весь процесс обеспечения процессуальных прав. В итоге автор приходит к выводу, что процессуальные гарантии включают в себя не только правовые средства, закрепленные в нормах права, но и гарантирующую деятельность определенных субъектов процессуальных правоотношений.
