Abstract

В статье анализируется механизм уголовного преследования по делам о налоговых преступлениях, введенный ст. 28.1 УПК. Институт, предусмотренный ст. 28.1 УПК, рассматривается автором как форма прекращения производства по делу, которая направлена на освобождение от уголовной ответственности лиц, обоснованно подвергшихся уголовному преследованию, но заслуживших своим посткриминальным поведением снисхождение государства, а также на упрощение правосудия в отношении таких лиц. С учетом этого делается вывод о процессуальной близости новой модели к институту прекращения уголовного преследования в связи с деятельным раскаянием (ст. 28 УПК).
