О Межотраслевом Регулировании Обстоятельств, Подлежащих Доказыванию, В Стадии Исполнения Приговора

Abstract

Автор статьи считает, что можно выделить конкретные группы обстоятельств в зависимости от вопросов, относящихся к одной категории. По его мнению, отражение имеющихся для доказывания обстоятельств в документах, направляемых в суд, - обязанность администрации учреждения или органа, исполняющего наказания. В статье приводятся законодательные источники, где содержатся указания на перечень документов, направляемых в суд, а также на различные обстоятельства, подлежащие доказыванию. Особое внимание автор уделяет актам об амнистии (помиловании) и тем обстоятельствам, которые подлежат доказыванию, при принятии решения о применении акта амнистии (помилования) по отношению к конкретному осужденному. Статья завершается выводом о том, что на законодательном уровне необходимо более четко регулировать обстоятельства, подлежащие доказыванию, при решении различных вопросов в стадии исполнения приговора
