Отличие Исключительных Прав Публикатора От Исключительных Прав Автора

Abstract

Статья посвящена новому, для российского законодательства, понятию «право публикатора». Введение данного понятия в законодательство обусловлено постоянным совершенствованием отечественного законодательства, приведением его в соответствие международным правовым документам. В статье рассмотрены исключительные права публикатора в сравнении с исключительными правами автора. Кроме подробного рассмотрения исключительных прав публикатора, в статье рассмотрена причина принципиально разного подхода к правам автора и правам публикатора. Основным критерием, согласно которого законодательно определен набор исключительных прав, является наличие творческого вклада в создание произведения. Именно по этому, исключительные права автора гораздо более шире, чем исключительные права публикатора. Публикатор не вносит творческого вклада в создание обнародованного произведение. В то же время представляется правильным закрепить законодательно механизмы защиты прав и поощрения публикатора, который приложил усилия к поиску и обнародованию ранее не обнародованного произведения.
