«Вертикальные» Формы Взаимодействия Органов Государственной Власти И Органов Местного Самоуправления В Сфере Наделения Государственными Полномочиями

Abstract

Статья посвящена взаимодействиям органов власти и местного самоуправления в сфере осуществления отдельных государственных полномочий органами местного самоуправления. Отмечается, что в сфере осуществления отдельных государственных полномочий взаимодействие носит властно-ориентированное содержание и, соответственно, им присущи отношения по «вертикали». «Вертикальные» взаимоотношения рассматриваются с двух ракурсов: «снизу вверх» право законодательной инициативы органов местного самоуправления, и «сверху вниз», которые преобладают во взаимоотношении органов государственной власти и органов местного самоуправления в сфере осуществления отдельных государственных полномочий. Определены основные виды взаимоотношений органов государственной власти с органами местного самоуправления в сфере наделения последних государственными полномочиями, начиная с передачи и реализации отдельных государственных полномочий, заканчивая прекращением осуществления полномочий.
