Abstract

Вопросы формы и содержания государственно-правовых явлений относится к числу содержательных характеристик государствоведения и правоведения. В статье представлены взгляды одного из ведущих специалистов по истории и теории государства и права в России во второй половине Х1Х века А.Д. Градовского. Автор анализирует идеи А.Д. Градовского через призму современного понимания в юридической литературе понятий форма государства, форма права, источники права. При этом источники права современной России рассматриваются с точки зрения закрепления основных прав и свобод человека и гражданина в нормативно-правовых актах Российской Федерации и их гарантированности.
