Abstract

Ряд новых позиций законодателя требует определенной доработки, уточнения, согласования с другими положениями УК РФ, а отдельные из них и проверки практикой. В первую очередь, это относится к конфискации имущества, несколько изменившей правовую природу, правовой статус, трансформировавшейся из вида наказания в одну из иных мер уголовно-правового характера. Регламентация этого института в действующем уголовном законе явно требует совершенствования.
