Abstract

В настоящей статье на основе анализа имеющихся точек зрения ученых-юристов формулируется и предлагается авторская концепция системного понимания правового статуса личности (человека и гражданина), доказывается – некорректность сведения указанного статуса к простой совокупности прав, свобод и обязанностей личности. Здесь же оригинально и по-современному раскрываются проблемы защиты права на жизнь как с теоретической, так и с юридико-практической точек зрения, критикуются отдельные неконституционные, по мнению автора, нормы федерального законодательства об основах охраны здоровья граждан.
