Abstract

В статье проводится анализ ст. 232 УК РФ, устанавливающей уголовную ответственность за организацию либо содержание притонов для потребления наркотических средств или психотропных веществ. Предлагается отказаться от использования понятия притон ограничивающего территориальный признак, сведя его к понятию «помещение», которое является более узким по сравнению с понятием «место». В статье обосновывается необходимость выделить такой признак объективной стороны как «предоставление помещения» без наличия признаков предусмотренных ч.1 ст. 232 УК РФ в самостоятельный состав. Приводится авторская редакция ст. 232 УК РФ.
