Проблемы Доказывания Легкомыслия На Досудебных Стадиях Уголовного Процесса

Abstract

Рассмотрена проблема практической возможности доказывания легкомыслия. Исследуется в какой степени объективные признаки (в теории уголовного права к ним обычно относят: личные качества; возможные действия других лиц, механизмов; физические или химические законы; обстановка) действительно могут быть использованы для целей доказывания легкомысленного отношении лица к своему деянию. Обосновывается, что все они формулируются очень размыто и не дают реальной возможности отграничить легкомыслие от косвенного умысла и даже от небрежности. Доказывается что современный вариант формулирования легкомыслия, во-первых, слишком размыт, а во-вторых, не отвечает элементарным представлениям о справедливости, и потому данная форма вины не может в полной мере использоваться в правоприменительной практике.
