Abstract

В статье проанализирована история становления и развития конституционных судов в Российской Федерации и иных государствах Центральной и Восточной Европы. Выявлены факторы, воздействовавшие на формирование органов конституционной юстиции, общие и особенные для Российской Федерации и государств Центральной и Восточной Европы. Установлена роль конституционных судов в национальных системах защиты прав и свобод человека и гражданина, а также влияние реализации идей прав и свобод человека и гражданина на формирование конституционных судов.
