Abstract

Статья посвящена одной из актуальных тем российского конституционного права проблемам теоретико-правового обоснования, а также вопросам правового регулирования принципов ограничения прав и свобод граждан Российской Федерации в условиях особых правовых режимов. Исследуются особенности законодательного закрепления термина «ограничение», раскрываются различные аспекты его использования применительно к правам и свободам граждан. В статье предлагается авторское определение понятия «ограничением прав и свобод граждан», которое охватывает практически все сущностные характеристики данного явления. Предложена классификация конституционных принципов ограничения прав и свобод человека и гражданина, позволяющая более четко представить все их видовое многообразие, а также анализ применения принципов ограничения прав и свобод человека и гражданина в условиях различных особых правовых режимов.
