Регулирование Несостоятельности Нормативными Актами Европейского Союза

Abstract

Предметом настоящей работы является обзор основного акта, регулирующего вопросы несостоятельности в странах Европейского Союза Регламент Совета ЕС № 1346/2000 от 29 мая 2000 года «О несостоятельности» (Council Regulation (EC) No. 1346/2000 of 29 May 2000 on Insolvency Proceedings). Регламент устанавливает прямой контроль над осуществлением судами своей компетенции по вопросу об открытии процедур несостоятельности в любой стране-участнице ЕС. Регламент также устанавливает унифицированные правила о выборе права, применимого к процедурам несостоятельности, а также к вопросам, которые связаны с такими процедурами. Существенная часть положений Регламента посвящена признанию решений судов стран-участниц ЕС в других странах-участницах. Тем не менее, положения Регламента не отменяют действия национального законодательства стран-участниц Европейского Союза, посвященного процедурам несостоятельности.
