О Некоторых Проблемах Допустимости Доказательств По Уголовным Делам

Abstract

Допустимость наряду с иными свойствами доказательств определяет возможность их использования в доказывании по уголовным делам. К проблемам допустимости доказательств относят вопросы формирования допустимых доказательств на основе результатов оперативно-розыскной деятельности, материалов доследственной проверки. Возможность использования указанных источников информации для раскрытия преступления не влечет однозначной возможности их использования в расследовании для доказывания обстоятельств, подлежащих установлению по уголовному делу.
