Репродуктивные Права В Системе Конституционных Прав И Свобод Человека И Гражданина В Российской Федерации

Abstract

В статье рассмотрены вопросы, связанные с формированием концепции репродуктивных прав человека и их место в системе конституционных прав и свобод человека и гражданина в Российской Федерации. Определена юридическая природа репродуктивных прав и сделан вывод о том, что они имеют комплексный характер и включают в себя целый ряд личных прав, которые закреплены в международно-правовых документах о правах и свободах человека, а также в Конституции РФ. Отмечено, что установление репродуктивных прав в международно-правовых актах с закреплением специальных правомочий, позволяет отнести их к числу самостоятельных прав, и предположить, что в настоящее время есть все необходимые предпосылки для выделения репродуктивных прав в отдельную, самостоятельную группу и причислению их к четвертому поколению прав человека.
