Целесообразность Как Условие Эффективности Уголовно-Правового Воздействия

Abstract

В статье анализируется правовая природа целесообразности в уголовном праве, ее соотношение с идей законности, а также значение целесообразности для обеспечения эффективности уголовно-правового воздействия; автор с использованием эмпирических материалов, опубликованных в юридической литературе и периодической печати, обосновывает необходимость при выборе меры уголовно-правового воздействия, виновному в совершении преступления лицу, ориентироваться не только на формальное соблюдение законодательных правил, регламентирующих ее применение, но и на целесообразность ее применения, т.е. на возможность с помощью данной меры максимально достичь целей уголовно-правового воздействия.
