О Некоторых Проблемах Государственно-Частного Партнерства В Развитии Инновационной Деятельности В Российской Федерации

Abstract

Статья посвящена анализу проблем правового регулирования государственно-частного партнерства в сфере развития инновационной деятельности. Автор приходит к выводу о том, что потенциал механизма государственно-частного партнерства, заложенного в федеральном законе о концессионных соглашениях в развитии инновационной деятельности полностью не реализован. Выделяются проблемы количественного и качественного расширения перечней объектов концессионных соглашений, принадлежности исключительных прав на результаты интеллектуальной деятельности за публично-правовыми образованиями, сторон концессионного соглашения, отсутствия в качестве обязательного критерия конкурса на право заключения концессионного соглашения наличие инновационной составляющей. Формулируются предложения по решению обозначенных проблем.
