Abstract

Работа посвящена одной из причин, по которой, по мнению автора, в современной правоприменительной практике существуют сложности при отнесении тех или иных фактов к обстоятельствам непреодолимой силы. Каждое жизненное обстоятельство, как явление реальной действительности, в котором участвует обязанное лицо, конкретно и требуется детальное рассмотрение данного обстоятельства на предмет отнесения его либо к непреодолимой силе, делающей невозможным исполнение обязательства, тем самым освобождая субъекта от гражданско-правовой ответственности, либо к обычному явлению, препятствующему исполнению обязательства.
