О Месте Подкупа Участников И Организаторов Профессиональных Спортивных Соревнований В Системе Особенной Части Ук Рф

Abstract

В статье посредством анализа объекта преступления, предусмотренного ст. 184 УК РФ «Подкуп участников и организаторов профессиональных спортивных соревнований и зрелищных коммерческих конкурсов», рассматривается вопрос о месте данной статьи в системе Особенной части УК РФ. На основании исследования общественных отношений, выступающих основным непосредственным объектом рассматриваемого преступления, автором делается вывод об ошибочности помещения ст. 184 УК РФ в раздел VIII и главу 22 УК РФ. Кроме того высказывается предположение о перспективе выделения в системе Особенной части УК РФ самостоятельной главы, предусматривающей уголовную ответственность за деяния, посягающие на те или иные разновидности общественных отношений в сфере спорта.
