Лишение Свободы Как Вид Наказания За Неосторожные Преступления

Abstract

Статья посвящена анализу результатов исполнения наказания в виде лишения свободы в составах преступлений, совершенных по неосторожности. Рассматривается вывод из ряда научных работ по уголовному и уголовно-исполнительному праву о неэффективности данного вида наказания. Исследование законодательства и практики исполнения лишения свободы, которое отбывается в колониях-поселениях, приводит автора к твердому убеждению в том, что лишение свободы в колонии-поселении не является эффективной мерой борьбы с преступностью вообще и с преступлениями, совершаемыми по неосторожности в частности, так как карательная сторона этого наказания значительно мягче лишения свободы, отбываемого в других исправительных учреждениях.
