El fraude inmobiliario y otros riesgos transaccionales en el derecho costarricense

Abstract

El artículo explora los alcances del fraude inmobiliario registral y sus modalidades, así como soluciones encontradas de las Salas civil y penal de nuestra Corte Suprema de Justicia, basadas a nuestro juicio en dos modelos contrapuestos como son el sistema Torrens y el sistema de seguro de títulos. Los costos transaccionales actuales y las características de un sistema económicamente eficaz para Costa Rica, sustentan los planteamientos que el autor hace sobre una agenda futura del sistema costarricense.
